94/62/EC directive update on the criteria example


Amendment to 94/62/EC Packaging Waste Directive

On February 8, 2013, Packaging and Packaging Waste Directive 94/62/EC was amended by Directive 2013/2/EU by giving examples of packaging based on the criteria set out by Article 3(1) of the legislation.

Criteria
Packaging materials
Not packaging
(i)        Items shall be considered to be packaging …, unless the item is an integral part of a product and it is necessary to contain, support or preserve that product throughout its lifetime and all elements are intended to be used, consumed or disposed of together.
ü        Sweet boxes;
ü        Film wrap around a CD case;
ü        Glass bottles for injection solutions ;
ü        Clothes hangers (sold with a clothing item);
ü        CD spindles (sold with CDs, not intended to be used as storage)
û    Tool boxes
û    Tea bags
û    Clothes hangers (sold separately)
û    CD spindles (sold empty, intended to be used as storage

(ii)        Items designed and intended to be filled at the point of sale and “disposable” items sold, filled or designed and intended to be filled at the point of sale shall be considered to be packaging provided they fulfill a packaging function.
Item designed and intended to be filled at the point of sale:
ü        Paper or plastic carrier bags;
ü        Disposable plates and cups;
ü        Sandwich bags;
ü        Aluminium foil;
ü        Plastic foil for cleaned clothes in laundries
û    Stirrer
û    Wrapping paper (sold separately)
û    Paper baking cases (sold empty)
û    Cake doilies sold without a cake

(iii)      Packaging components and ancillary elements integrated into packaging shall be considered to be part of the packaging into which they are integrated. Ancillary elements hung directly on, or attached to, a product and which perform a packaging function shall be considered to be packaging unless they are an integral part of this product and all elements are intended to be consumed or disposed of together.
ü        Sticky labels attached to another packaging item;
ü        Staples;
ü        Plastic sleeves;
ü        Mascara brush which forms part of the container closure
û    Radio frequency identification (RFID) tags
